Law Society of Kenya (LSK) has denounced the National Police Service’s decision to revoke Chief Justice Martha Koome’s security detail.

Speaking on behalf of LSK, President Faith Odhiambo emphasized the critical role of an independent judiciary in governance and urged security agencies to ensure equal protection for all citizens, highlighting the need for impartiality and fairness in their operations.

“The Constitution spells out the separation of powers through the three arms of government, which have similar status and priorities. The mistaken perception that the Judiciary is subordinate to the other arms must be deconstructed,” Odhiambo said.

Odhiambo also condemned the National Police Service for appearing to operate as an extension of the Executive, which undermines the authority of the Judiciary. She stated, “While we acknowledge the Inspector General of Police has provided an explanation, it is important to emphasize that the Chief Justice’s security is a serious matter, not something to be taken lightly.”

Shortly after Koome revealed the withdrawal of her security, Inspector General of Police Douglas Kanja explained that the officers from the Judiciary Police Unit had been recalled for training following promotions or were being transferred to different postings. Koome condemned this action as a violation of constitutional principles and an outright threat to the independence of the judiciary.

“Security for the Chief Justice is not a personal privilege but a structural necessity to ensure the judiciary can function autonomously and without fear,” CJ Koome said.

She also highlighted that security acts as an essential institutional safeguard, designed to protect judicial officers and processes from threats that could compromise the integrity of justice.
